Apple sued for not removing Telegram from App Store

Apple was sued by Coalition for a Safer Web for failing to remove Telegram at the same time Parler was blocked by the Cupertino giant. The complainant claims that this alternative to WhatsApp should also have been removed from the App Store.

It also reads in the petition, l submitted to a California district court, that Telegram’s services are used by extremists and social agitators, another reason for its removal from the App Store, the iOS app store.

Capitol violence allegedly orchestrated through Telegram and Parler

The case that puts Apple on the dock was born in the aftermath of the recent violence on Capitol Hill, the heart of American politics and nation in which Parler was instrumental. Now, the plaintiff also points the accusatory finger at Telegram.

Coalition for Safer Web, an organization that fights for a healthier Internet, condemns Apple for allowing Telegram to remain available on the App Store. This “despite Apple knowing that Telegram is used to intimidate, threaten and coerce members of the public“.

The case was first put forward by The Washington Post which also publishes the document – Scribd format – with the full application. There we can assess the parties, the alleged causes, among other legal details.

Who is the Coalition for a Safer Web (CSW)?

Telegram

It asserts itself as a non-governmental entity, which does not aim to obtain profit. It wants to create a more tolerant Internet without extremism or terrorist content. That said, given Apple’s inability to enforce the App Store Terms of Use, it now sues Tim Cook’s company for allowing this platform to be used to promote organized violence.

The lawsuit comes in roughly the same week that Apple, Google and Amazon severed all ties with Parler. The social network did not moderate users and shared content, causing it to not only be removed from the App Store and Play Store, but also its servers to be disabled by Amazon Web Services.

Like Parler, Telegram should have been removed from the App Store

The lawsuit puts pressure on Apple to closely monitor Telegram, the instant communications platform with end-to-end encryption. According to the complainant, her services are also used to promote and organize criminal activities.

Taking the testimony of a CSW spokesperson, Telegram will be used as “communication channel for the government of Russia and other neo-Nazi groups, of white supremacy and affiliated groups, spreading disinformation and promoting the rational separation of the United States of America and Europe “.

The same source asked Apple last July to remove Telegram from its platform, albeit temporarily. The rationale, as now, was “Telegram’s role in encouraging hate and extremism”.

Finally, in the initial petition we see the accusation that Telegram is being used to plan new riots during the taking of power by President-elect Joe Biden on January 20, 2021.

The case now follows the judicial procedures of the State of California in the United States of America.
